The current EU transition also needs careful date control. A common weakness is citing only “16 CFR Part 1250” without listing the applicable ASTM F963 sections. Separate federal requirements—such as total lead, lead in paint, phthalates and small parts—should use the proper legal citations rather than being hidden under a broad ASTM reference.

Since July 8, 2026, importers of most regulated consumer products must electronically file certificate data before the goods enter U.S. commerce. A new fabric source, plastic formulation, pigment, coating, filling, eye component, magnet, sound unit, pattern, size, age grade or production site can affect existing evidence. Not every change requires a complete retest, but every safety-relevant change should be assessed before release.

What Are the EN 71 and CE Requirements for Plush Toys?

A custom plush toy offered in the European Union normally needs more than an EN 71 report. The complete route includes product classification, age grading, a documented safety assessment, applicable testing, technical documentation, an EC Declaration of Conformity, traceability details, required warnings and CE marking. EN 71 provides recognised test methods; CE marking records the responsible producer’s declaration that the finished toy meets every applicable EU requirement.

What Is the EN 71 Certificate for Toys?

“EN 71 certificate” is common commercial wording, but EN 71 is a series of European toy-safety standards rather than a permanent licence issued to a factory or product family. A laboratory usually issues a report identifying the submitted sample, the standard edition, the clauses tested and the results.

CEN-CENELEC identifies EN 71-1 for mechanical and physical properties, EN 71-2 for flammability and EN 71-3 for migration of certain elements. Other EN 71 parts address specialised products and hazards, while EN IEC 62115 applies to electrical toys where relevant.

A useful report should be checked against the finished item, not accepted by title alone. It should show:

The evidence becomes much stronger when the report is connected to a controlled bill of materials, approved pattern, colour references, embroidery file, print file, filling specification and sealed sample. EN 71-1 can examine whether small parts detach after foreseeable use, whether seams expose filling, whether rigid items create sharp edges or points, and whether cords, loops, packaging film or accessible mechanisms create hazards. Age grading affects the test conditions and how foreseeable behaviour is considered.

EN 71-2 addresses flammability. Pile length, fibre type, loose fur, clothing, capes, trims, foam backing and surface finishes can change the finished toy’s behaviour near an ignition source. Testing a stock fabric sample is weak evidence when the approved item will use custom-dyed fabric with a different pile or finish.

EN 71-3 covers migration of certain elements from accessible materials. One plush can contain several separate test portions:

Is EN 71 Testing Enough for CE Marking?

No. EN 71 testing is supporting evidence, while CE marking is the result of a complete conformity process.

Under the current Toy Safety Directive route, the responsible producer must:

Using harmonised standards can provide a presumption of conformity for the requirements they cover. It does not remove the duty to check whether every relevant hazard is covered. A basic plush may follow internal production control, while an unusual structure, incomplete standard coverage or complex function may require notified-body involvement.

The technical file should allow a competent authority to understand how the toy was designed, assessed, tested and reproduced. Under Directive 2009/48/EC, it includes, where relevant:

  • A detailed design and production description.
  • A list of components and materials.
  • Safety data sheets for chemicals used.
  • The completed safety assessment.
  • The conformity route followed.
  • A copy of the EC Declaration of Conformity.
  • Production and storage addresses.

The technical file and declaration must be retained for ten years after the toy is first placed into EU distribution. Product changes and revisions to referenced harmonised standards must be assessed rather than silently carried into later orders.

CE marking must be visible, legible and indelible. It may appear on the toy, an attached label or the packaging. For small toys, a label or accompanying leaflet may be used under the conditions established by the Directive. If the mark is not visible from outside the packaging, it must at least appear on the packaging.

A passing report therefore does not cure:

Do Handmade Toys Need a CE Mark?

Handmade status does not create a general exemption.

A sewn figure is treated as a toy when it is designed or intended, whether exclusively or not, for use in play by children under 14. If it meets that definition and is offered in the EU, the safety assessment, conformity route, technical file, declaration, traceability and CE duties still apply.

A decorative textile figure intended only for adult display may fall outside toy rules, but classification must agree with its real presentation and foreseeable use. Relevant factors can include:

The aim is not to remove the handcrafted appearance. It is to keep essential construction consistent from one unit to the next.

Who Issues the EU Declaration of Conformity?

Under the current Directive, the entity legally treated as the manufacturer issues the EC Declaration of Conformity and assumes responsibility for the toy.

This is the party that produces the toy or has it designed and produced, then offers it under its own name or trademark. An importer or distributor that places its own name on the toy or changes the product in a way that may affect compliance can take on the same responsibilities.

The laboratory does not normally issue the declaration. It supplies supporting evidence.

The declaration must identify the toy clearly and remain continuously updated. It includes:

The item number, image, standards, production site, reports and packaging should all describe the same version. A declaration for embroidered eyes should not accompany stock with plastic eyes. A declaration citing EN 71-3 should not rely on a report that never assessed the applicable materials.

The EU importer must verify that the conformity process was completed, the technical file exists, CE marking and traceability details are present, and the toy carries required instructions and warnings. The importer must keep a copy of the declaration for ten years and ensure the technical file can be supplied to authorities when requested.

From August 1, 2030, Regulation (EU) 2025/2509 will replace the Directive’s main route. It introduces a digital product passport that replaces the current toy declaration and carries product identity, responsible-party details, legal references, standards, notified-body information and CE data through a physical data carrier.

The Regulation is already in force. Selected institutional provisions have applied since January 1, 2026, while its principal product duties apply from August 1, 2030. Toys lawfully placed under Directive 2009/48/EC before that date receive transitional treatment, and qualifying EC-type examination certificates may remain valid until February 1, 2031 unless they expire earlier.

Do UK Plush Toys Need Separate Compliance?

Yes. Great Britain and Northern Ireland should be planned separately from the European Union.

For England, Scotland and Wales, the Toys (Safety) Regulations 2011 apply. CE marking is recognised indefinitely in Great Britain, and UKCA may also be used under the applicable route. Technical documentation, a declaration, traceability details, warnings and continuing-production controls are still required. Relevant records must generally be kept for ten years.

Where self-declaration is permitted in Great Britain, either CE or UKCA may be used if the relevant requirements are met. If independent assessment is required, the choice of EU Notified Body or UK Approved Body affects which marking can lawfully appear.

Northern Ireland follows the CE route. Where a UK Approved Body is used for required third-party assessment, CE and UKNI are both needed. A product carrying CE and UKNI together cannot be distributed in the EEA under that marking combination.

One packaging design may sometimes carry several legitimate markings and addresses, but symbols should not be added without confirming the legal route. CE, UKCA and UKNI are not decorative logistics marks.

The matrix is not a laboratory quotation. The age grade, materials, rigid parts, filling, sound units, magnets, batteries, removable accessories and intended countries still need a product-specific review.

Which Chemical Tests Apply to Plush Materials?

Chemical work follows accessible materials and foreseeable exposure. “Polyester plush” is rarely a complete material description. One toy may contain dyed fabric, embroidery thread, printed coating, artificial leather, PVC shoes, metal hardware, adhesive, plastic pellets and a coated zipper pull.

Material reports should connect to the actual source, colour, formulation and lot. A generic report for “blue polyester” has limited value if the approved fabric comes from a different dye house or uses another finish. Similar appearance does not establish chemical equivalence.

Added features should be reviewed before the final pattern is frozen. Replacing a detachable eye with embroidery may remove a choking concern and reduce the number of chemical test portions. Moving pellets into a separately sewn pouch may prevent leakage. Shortening a loop during sampling is easier than reworking completed stock.

Age grading affects test methods, use-and-abuse severity, small-parts rules, warnings and whether certain features are suitable at all. It should be based on the design and foreseeable use, not selected only to reduce testing.

EU importers must verify that CE marking, traceability information, warnings and instructions are present before placing the toy into distribution. Great Britain requires safety warnings to be visible, legible, understandable, accurate and preceded by “Warning” or “Warnings”; the same guidance also requires continuing production to remain in conformity.

Warnings should address a genuine residual hazard. “Use under adult supervision” does not repair a detachable component. Language requirements must also be checked country by country; one English-only label is often insufficient for EU distribution.
