A custom plush character may look harmless because most of its body is soft fabric and polyester filling. Yet the parts that appear least important often decide whether it can be legally distributed: a six-millimetre plastic eye, a loosely secured pom-pom, a coated metal keyring, an internal pellet pouch or a warning label that does not match the intended age.
This is why asking whether a plush toy is “ASTM certified,” “CPSIA certified” or “EN 71 certified” rarely produces a complete picture. These terms describe different standards, legal duties, test routes and documentation. They do not form a universal certificate that follows every design produced in one facility.
Custom plush toys can be developed and submitted for third-party testing against applicable ASTM F963, CPSIA, EN 71 and other destination-country requirements. The test scope must be determined from the actual design, intended age, materials, accessories and final use. A passing report is meaningful only when its sample, photographs, bill of materials and model information correspond to the version entering production.
Consider two 20-centimetre plush bears. The first uses embroidered eyes, short-pile polyester fabric and standard fibre filling. The second uses plastic eyes, a removable jacket, a metal chain and plastic pellets in its base. Their size and character category are similar, but their hazard profiles are not. A report prepared for the first bear cannot simply be attached to the second.
A reliable safety file therefore begins before sampling. The structure is reviewed, the intended age is defined, materials are identified, foreseeable misuse is considered and the final sample is tested under the rules that genuinely apply. That sequence may sound less exciting than choosing fur colors or adjusting a smile, but it is often the difference between a smooth launch and cartons being held while missing evidence is reconstructed.
What Safety Standards Apply to Custom Plushies?

Custom plushies may require mechanical, physical, flammability, chemical, electrical and labeling controls. In the United States, applicable ASTM F963 provisions operate alongside CPSIA and other CPSC rules. In the European Union, relevant EN 71 standards support the CE conformity process. The correct scope depends on intended age, construction, materials, detachable parts, functions and the destination country.
Stuffed Toy Safety
A stuffed toy is not assessed only because it feels soft. During foreseeable use, a child may pull an ear, twist a plastic eye, bite a nose, swing the item by a loop, open a weak seam or press against an internal component. Safety work therefore examines the assembled design under stress, not only the fabric and filling in isolation.

The intended use changes the result. A 10 cm character with a metal chain may be presented as a bag charm, yet its shape, retail placement and promotional images may still give it clear play value. A “14+ collectible” statement is also not a reliable shortcut when the product’s appearance and promotion strongly appeal to children.
In the United States, toys designed or intended primarily for children aged 12 or younger generally require testing by a CPSC-accepted third-party laboratory when they are subject to children’s product rules. Products intended for children under three must not contain prohibited small parts or release them after the relevant use-and-abuse tests.
In the EU, Directive 2009/48/EC presently covers products designed or intended for play by children under 14. The safety assessment must consider intended and foreseeable use, including the behavior and abilities of children under 36 months and other specified age groups.
ASTM F963 and CPSIA
ASTM F963 is a technical toy safety standard. CPSIA is US legislation that made the applicable toy standard mandatory and added wider duties for children’s products. A children’s plush toy does not comply by choosing one or the other; it may need applicable ASTM F963 sections together with additional CPSC-enforced limits, third-party testing, tracking information and a Children’s Product Certificate.
For toys produced on or after April 20, 2024, the mandatory US version is ASTM F963-23. The applicable sections depend on the actual design, and CPSC guidance recommends obtaining a laboratory quotation that identifies which sections will be tested rather than requesting a vague “full ASTM test.”
Important US thresholds include:
- Accessible components of children’s products: no more than 100 ppm total lead.
- Paint and similar surface coatings: no more than 90 ppm lead.
- Each regulated phthalate in an accessible plasticized component: no more than 0.1%, equal to 1,000 ppm.
- Products intended for children under three: no prohibited small parts before or after applicable use-and-abuse testing.
These numbers should be mapped to actual components. A soft polyester body may present little lead concern, while a painted metal charm, flexible PVC badge, plastic shoe or coated eye can require separate review. Likewise, embroidered facial details may reduce detachable-part risk, but dense embroidery can stiffen thin fabric or create accessible backing if the construction is poorly designed.
A useful US scope review asks:
- Which ASTM F963 sections apply to the final structure?
- Which components are accessible after use-and-abuse testing?
- Are any paints, coatings or plasticized parts present?
- Does the intended age create a small-parts restriction?
- Which laboratory reports support each rule listed on the CPC?
- Do the report photographs, model number and materials match the production version?
A CPC is not a laboratory award. It is issued by the responsible US importer or domestic producer and must identify the applicable rules and supporting third-party evidence. For children’s toys, CPSC guidance directs the certificate to cite 16 CFR Part 1250 and list the applicable ASTM F963 sections.
EN 71 and CE
EN 71 is a series of European toy safety standards. CE is the conformity marking applied after the responsible legal producer has completed the required safety assessment, conformity route, technical documentation and declaration. Passing several EN 71 tests supports CE work, but it does not complete every legal step.
For a standard soft-filled toy, the most familiar starting areas are:

These are starting areas, not a universal package. Magnets, batteries, sound modules, scented materials, rigid vinyl parts or unusual coatings may introduce additional standards or legal requirements. The current list of harmonised standards must also be checked because references are published and amended through the Official Journal; the European Commission’s consolidated toy-standard listing includes a September 2025 amendment.
“EN 71 compliant” should therefore mean that:
- The relevant EN 71 parts were selected for the actual product.
- The laboratory sample used the approved materials and construction.
- The report clearly identifies the model, photographs, age grade and test methods.
- Any exclusions, limitations or remarks have been reviewed.
- Other applicable EU duties have not been ignored.
- Ongoing production is controlled against the assessed version.
Before a toy is distributed in the EU, the responsible legal producer must analyze chemical, physical, mechanical, electrical, flammability, hygiene and radioactivity hazards; complete the appropriate conformity assessment; prepare technical documentation; issue the Declaration of Conformity; affix CE marking; and provide required identity, traceability, warnings and safety information. Importers must verify that these steps have been completed.
CE should not be described as a general certificate issued by an EU authority. Under the self-verification route, harmonised standards covering all relevant hazards may be applied together with internal production control. When harmonised standards do not fully cover the design or are not correctly applied, EC-type examination by a notified body may be required.
Regulation (EU) 2025/2509 entered into force on January 1, 2026, with most provisions applying from August 1, 2030. Until the main transition date, the existing Directive remains central for toys distributed in the EU, while long-running product programs should prepare for the newer regulation’s stronger chemical controls and digital product-passport requirements.
Age Grading
Age grading is a technical decision, not a label chosen after the design is finished. It influences small-part controls, test severity, warnings, materials and how foreseeable misuse is assessed.
The review should consider:
- Character style and visual appeal
- Product size and total weight
- Detachable or removable components
- Play pattern, such as cuddling, dressing, carrying or interactive use
- Skill needed to operate any function
- Packaging language and imagery
- Online descriptions and promotional photographs
- Retail placement
- Whether the product resembles a nursery, preschool or collector item
A warning must not contradict the product’s actual function. For example, a plush promoted as a comfort companion for toddlers cannot rely on a higher age statement to preserve small detachable decorations. EU rules expressly require warnings to be accurate and not conflict with intended use as determined by function, dimensions and characteristics.
Age grading also affects design economics. Embroidered eyes may remove a detachable plastic component. Shortening a ribbon can reduce loop risk. Sewing a badge as appliqué can avoid a loose accessory. Adding a second inner pouch can improve containment for weighted filling. These changes are usually easier before formal sampling than after testing, packaging and photography are complete.
Product Risk Map
The most accurate test scope begins with a component-level risk map. Each material, part and function should be linked to the hazard it creates and the evidence needed to control it.

This table also prevents overreliance on raw-material reports. A fabric report may support chemical selection, but it does not establish seam strength, eye retention, cord dimensions, filling containment or the assembled product’s flammability behavior. A finished-product report, in turn, remains relevant only while the tested construction and critical materials remain unchanged.
Colorways require similar care. Two SKUs may share one paper pattern while using different dyes, prints, threads or plastic pigments. Mechanical work may sometimes be grouped, but chemical coverage should follow an approved material matrix. One pale color cannot automatically represent every dark or heavily printed variation.

EU rules require technical documentation and the Declaration of Conformity to be retained for ten years, and they require procedures that keep series production in conformity when the design or harmonised standards change.
For Heyzizi projects, compliance language is intentionally product-specific: third-party testing can be supported according to destination-country requirements; test plans are determined by product type, age grading, materials and destination; nominated laboratories and retail protocols can be accommodated; and documents are managed by product version and production batch.
The strongest claim is not “certified for everything.” It is a traceable statement showing what was assessed, which version was tested, which rules were applied, and how later production remains equivalent to the approved sample.
Which Requirements Apply in the US and EU?
Custom plush toys entering the United States or European Union must follow different legal routes. US children’s toys may require applicable ASTM F963 testing, CPSIA-related chemical limits, third-party evidence, a Children’s Product Certificate, tracking information and electronic certificate filing. EU toys require a safety assessment, relevant EN 71 work, technical documentation, a Declaration of Conformity, CE marking, traceability and correctly presented warnings.
US Legal Route
The first US decision is whether the plush item is a children’s product and a toy. Products designed or intended primarily for children aged 12 or younger fall within the children’s-product definition. When such a product is subject to a CPSC-enforced safety rule, it generally requires testing by a CPSC-accepted third-party laboratory and certification through a Children’s Product Certificate, commonly called a CPC.
For children’s toys produced on or after April 20, 2024, the mandatory toy-standard version is ASTM F963-23. The federal requirement is incorporated through 16 CFR Part 1250. The production date matters: an old report prepared under an earlier ASTM edition should not be attached to a new shipment without checking which edition applies to the actual production lot.

For products produced outside the United States, the importer issues the CPC. The laboratory provides testing and results but does not issue the certificate. The importer may rely on valid test evidence supplied by another party, provided due care is exercised and the supporting records remain accessible.
A CPC must identify seven core elements:
- The product covered
- Every applicable CPSC rule
- The certifying importer or domestic producer
- The person maintaining the supporting records
- The date and place of production
- The date and place of testing
- The CPSC-accepted laboratory that performed the work
The certificate and supporting test records must be in English. A broad product description such as “plush toy collection” may be inadequate when several designs use different age grades, materials, attachments or functions.
Since July 8, 2026, importers of regulated consumer products subject to certification must electronically file certificate data through US Customs and Border Protection before entry into US commerce. Products entered from a Foreign Trade Zone follow the later effective date of January 8, 2027. This makes accurate SKU, production, laboratory and certificate data part of import preparation rather than a document assembled after arrival.
Children’s products also require permanent tracking information on the item and packaging, where practicable. The information must allow the responsible party, production place, production date and batch or run to be identified.
ASTM F963 Scope
ASTM F963 is broad, but not every section applies to every plush design. A laboratory should review the finished structure and identify the applicable sections in its quotation.
A simple embroidered stuffed animal presents a different hazard profile from a plush keychain, weighted plush or electronic character.

ASTM F963 provisions that restate existing federal rules are not always certified through 16 CFR Part 1250 in the same manner as other sections. Flammability is a notable example: the hazard remains relevant, but the federal flammability requirement is addressed separately rather than treated as an ordinary mandatory ASTM F963 section on the CPC.
The CPC should therefore list:

- Separate lead, phthalate, small-part or other federal rules where applicable
- Any valid exemption or determination being relied upon
A statement such as “full ASTM passed” is less useful than a report showing the tested sample, applicable clauses, measured results, photographs and limitations.
CPSIA and Chemical Controls
CPSIA-related requirements extend beyond the mechanical structure of the plush toy. Accessible materials and components may need review for lead, surface coatings and regulated phthalates.
Important US limits include:

These limits apply at component level. A polyester body may present a different chemical concern from a painted charm, flexible PVC badge, plastic shoe, coated zipper pull or printed patch.
Surface-coating classification deserves particular attention. When an ink or coating can be scraped from the substrate, it may be treated as a surface coating and assessed against the 90 ppm lead limit. When color is integrated into the textile and cannot be separated as a coating, a different lead-content analysis may apply.
For a plush doll with coated plastic shoes and a metal accessory, the US file may need to connect:
- ASTM F963 mechanical results
- Small-part assessment
- Total-lead results for accessible plastic and metal
- Surface-coating lead results
- Phthalate results for flexible plasticized parts
- Tracking-label information
- The final CPC
- Production-lot records
Testing only the main fabric would leave much of that evidence missing.
CPC coverage also depends on continued production consistency. CPSC guidance allows one certificate to cover several materially unchanged lots when due care is exercised and the certificate accurately identifies the covered production dates or lots. A later change to the eye resin, printed coating, keyring plating or intended age may require another assessment and an updated certificate.
EU Legal Route
For toys distributed in the EU before the main transition date, Directive 2009/48/EC remains the central toy-safety law. Regulation (EU) 2025/2509 entered into force on January 1, 2026, while most of its provisions apply from August 1, 2030. Toys lawfully placed into circulation under the Directive before that date may continue to be made available under the transition rules.
The current EU route requires more than an EN 71 report.
Before a toy is distributed, the responsible legal producer must:

- Analyze chemical, physical, mechanical, electrical, flammability, hygiene and radioactivity hazards
- Assess foreseeable exposure to those hazards
- Select the correct conformity procedure

- Maintain production controls that keep later units equivalent to the assessed design
EU importers must verify that the conformity procedure has been completed, technical documentation is available, CE marking is present, responsible-party information is shown and required warnings accompany the item.
Two conformity routes are available:

Passing EN 71-1, EN 71-2 and EN 71-3 does not automatically complete every EU chemical duty. REACH Annex XVII restrictions may apply to substances contained in fabrics, plasticized parts, coatings, metal components and other finished articles. ECHA also maintains a separate list of substances restricted in toys under the Toy Safety Directive.
The General Product Safety Regulation may add obligations in areas not fully addressed by sector-specific toy rules, particularly traceability, distance sales, responsible economic operators, corrective action and information shown in online offers. For products produced outside the EU, online listings may need the name and postal and electronic address of the EU responsible person.
From August 1, 2030, Regulation (EU) 2025/2509 will introduce the principal new toy-safety system, including the digital product passport and stronger information available to customs and enforcement authorities. Long-running plush collections should therefore maintain stable model references, digital test files, version-controlled bills of materials and traceable production lots well before 2030.

An age statement cannot correct a design that clearly appeals to younger children. Both US and EU systems consider intended and foreseeable use. A toddler-style character presented as a comfort toy should not rely on a higher printed age merely to retain detachable decorative parts.

Neither route supports a universal statement that every plush design is automatically compliant. The evidence must belong to the actual product version.

How Is a Custom Plush Test Plan Built?

A custom plush test plan is built from the actual product—not from a fixed certificate package. Intended age, use, construction, fabrics, filling, coatings, detachable parts, magnets, electronics and destination country determine the scope. The strongest plan connects the approved design, material list, representative samples, laboratory methods, test reports, final specifications and production lot without unexplained substitutions.
Product Classification
The first task is deciding what the product legally is. A stuffed animal, infant comfort item, adult collectible, bag charm, promotional decoration and pet product can look similar while following different rules.
